BY AGREEING TO THE TERMS OF THIS WAIVER YOU ARE SUBSTANTIALLY WAIVING YOUR LEGAL RIGHTS INCLUDING THE RIGHT TO SUE. PLEASE DO NOT SUBMIT THIS WAIVER ELECTRONICALLY UNTIL YOU HAVE CAREFULLY READ, UNDERSTAND AND AGREE TO ITS CONTENTS. WE ENCOURAGE YOU TO SPEAK WITH A LAWYER BEFORE SUBMITTING THIS WAIVER.
In consideration of being allowed to participate in PBHL activities, including but not limited to ball hockey, PBHL social functions or other sports activities put on by the PBHL, I agree and accept as follows:

1. I, the player, wishing to participate in PBHL, am 18 years old and have personally completed the registration form(s) truthfully and accurately and agree that I am fully responsible for updating same should any information provided require an update.

2. I further represent that I have never been expelled or barred from registering with any adult hockey organization in Alberta for reasons of violence or other misconduct.

3. I certify I have no known medical conditions that would prohibit me from participating in the sport of ball hockey. I am aware that the PBHL strongly recommends each player receive a medical check-up prior to participating in any event. I understand that I must wear a certified protective helmet at all times, even when I am not playing, when I am in the competition area which includes the penalty boxes, time keeper's booth and team benches.

4. I understand that the PBHL strongly recommends that players wear full face shields or visors and any other protective ball-hockey equipment including but not limited to cups, elbow pads, shin and pads which could reduce the risk or severity of injury because collisions or contact (accidental, incidental or purposeful) with other players, officials, equipment, the ball, the boards, are common in the sport of ball hockey and can result in serious injury and or death.

5. I acknowledge and fully understand that the sport of ball hockey is inherently dangerous and may result in serious injury, disability or and or death and severe social and economic losses which might result not only from the player's actions, inactions or negligence, but also from the action, inaction or negligence of others, the rules of play or the condition of the premises or competition area and all equipment to be used. Further, there may be other risks not known to me or the PBHL and there may be risks not reasonably foreseeable at this time.

6. I agree that prior to participating in any PBHL activity, I will inspect the competition area and all equipment used by the PBHL and if, through my inspection, I determine that anything related to that PBHL activity is unsafe, I will immediately advise the director of the PBHL, my team captain and the referee of this unsafe condition and not participate until the condition is corrected.

7. I assume all foregoing risks and accept personal responsibility and liability for any damages or costs following any injury, permanent disability or death to me during PBHL activities and I will not sue or seek redress from the PBHL for same.

8. I agree to always act in a mature and responsible manner before, during or after PBHL activities. I understand that, as a member of the PBHL, I represent PBHL to the general public. I understand and agree that any behaviour that the PBHL, at their sole discretion, deemed to jeopardize or harm the PBHL's reputation or economic interests will result in disciplinary action against me.

9. I agree to reimburse the PBHL in full, within ten days of notice, for the cost of any property damage for which I am held responsible for by the PBHL.

10. I understand and agree that I may be, fined, suspended, expelled or otherwise disciplined by the PBHL and/or from the PBHL immediately and without refund for conduct detrimental to the PBHL, deemed at PBHL's sole discretion, including but not limited to:

a. Failure to abide by any PBHL rules, policies, directives which may be implemented or revised from time to time without any notice to me;

b. Falsification of registration information or incident reports;

c. Receiving two game misconduct penalties within a period of twelve calendar months;

d. Receiving one game misconduct penalty and one match penalty within a period of twelve calendar months;

e. Receiving two match penalties within a period of twelve calendar months;

f. Excessive penalty minutes within a period of twelve calendar months;

g. Swearing, spitting, fighting, threatening, insulting or otherwise being disrespectful to, directors, officers, players, coaches, fans, volunteers, independent contractors, sponsors, of the PBHL, before, during or after PBHL activities or on social media or traditional media outlets;

h. Failing to pay registration fees, disciplinary fees, forfeit fees or other monies payable to the PBHL promptly when requested;

i. Participating in any PBHL activity while under the influence of drugs and/or alcohol;

11. I agree the terms 'PBHL', 'Punjabi Ball Hockey League' and any of its logos are exclusive property of the PBHL and shall not be used by me in any manner for any other purpose without the express written approval of the PBHL.

12. I, do hereby consent to the continuous collection and use of my personal information (including but not limited to my first and last name, address, phone number, postal code, email addresses, date of birth, hometown, height, weight), personal images, athletic results, statistics and awards, prizes received, verbal quotes, and all other information provided to the PBHL. I understand and agree that this information will be used for marketing purposes and could be posted on league websites, blogs, social media accounts or in traditional print. I transfer all rights to this said information to the PBHL but agree that the PBHL will bear no liability for protecting the confidentiality of said information.

13. I (and my heirs, successors, administrators, representatives, assigns, agents, insurers, trustees, executors) does hereby remise, release and forever discharge PBHL (and its successors, administrators, representatives, assigns, agents, insurers, directors, shareholders and officers), from any and all claims, complaints, demands, general damages, special damages, debts, liabilities, statutory rights and obligations, causes of action, matters, things, suits and costs of suit of whatever nature, character, description, whether known or unknown and whether anticipated or unanticipated which I had, have, claim to have, or may hereafter have or claim to have against PBHL, by reason of or arising out of any cause whatsoever existing at any time up to and including the date hereof that is in any way related to my participation in the PBHL or any actions related to or arising from my participation in the PBHL.

14. I agree that this Waiver shall be governed by the laws of the Province of Alberta, Canada and I hereby attorn to the jurisdiction of the Courts of Alberta for any matter which arises concerning this Waiver.

15. I agree that if any paragraph, clause and covenant contained in this Waiver is found to be invalid, illegal or unenforceable, such paragraph, clause or covenant shall be severed or modified in such a manner as to afford PBHL the fullest protection commensurate with entering into this Waiver, as modified, legal, enforceable under applicable laws and the balance of this Waiver shall remain in full force and effect notwithstanding such severance or modification, the balance being construed as severable and independent. To the extent permitted by law, I waive any law, rule or regulation that might otherwise render any paragraph, clause or covenant of this Waiver invalid, illegal or unenforceable.

16. I also declare that:

a. I have carefully read this Waiver;

b. I fully understand the entire Waiver to be a binding contract;

c. I acknowledge that I am signing this Waiver of my own free will and that no promise, inducement or agreement other than those expressed herein have been made;

d. I have had the opportunity to consult or have consulted and received advice from own lawyer, before signing this Waiver;

e. By submitting this Waiver electronically, it should be considered to have the same effect as having been signed by me in hard copy format;

f. I electronically submit this Waiver with the intent and knowledge that it will be fully and legally binding upon me and will significantly impact my right to sue or seek redress from the PBHL;

17. I declare that this Waiver constitutes the entire agreement between respecting all matters set forth herein, and there are no oral statements, representations, warranties, undertakings, or collateral agreements between me and the PBHL modifying or affecting the terms hereof.
